Acceptance of Terms

By accessing or using this service, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

Description of Service

We provide a software-as-a-service platform. We may modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use or security breach.

Acceptable Use

You agree not to:

• Violate any applicable laws or regulations.
• Infringe on the intellectual property or other rights of any party.
• Attempt to gain unauthorized access to our systems or data.
• Interfere with or disrupt the integrity or performance of the service.
• Use the service to send spam, malware, or other harmful content.

In addition, because Encorist is an AI video generation service, you must not:

• Create deepfakes, impersonations, or deceptive media that infringes another person's privacy, likeness, or intellectual property without documented permission.
• Upload or generate content depicting or involving minors in any sexual, romanticized, inappropriate, or exploitative context; we may reject these requests outright.
• Produce NSFW, sexually explicit, pornographic, sexually suggestive, hateful, harassing, violent, or exploitative material, or use Encorist for surveillance, discrimination, exploitation, or any other unlawful activity.
• Attempt to bypass or interfere with our content-safety systems or use the service in ways designed to evade them.

We may suspend or terminate access for any account that violates these rules, and we may report suspected illegal activity to the relevant authorities.

Payment and Billing

Paid features are billed in advance for the selected billing period. You are responsible for providing accurate billing information. Credits have no cash value, cannot be transferred, and expire as described in our Refund Policy: monthly plan credits at the end of the billing period, yearly plan credits after one year, and credit pack credits after 180 days. Refunds and returned credits are handled as described in that policy.

Your Content and Generated Videos

• You keep the rights you have in the images, videos, and text you upload ("Inputs"). You confirm that you have every right and permission needed to upload them, including consent from any real person who appears in them.
• You give us a limited license to store and process Inputs and generated videos only to provide and secure the service.
• As between you and Encorist, you own the videos you generate ("Outputs") and we claim no ownership of them. You may use Outputs for personal and commercial purposes, as long as your Inputs and your use comply with these Terms, our Acceptable Use Policy, and applicable law.
• Outputs are made by third-party AI models. Similar outputs may be produced for other users, and we do not guarantee that an Output is unique, eligible for copyright protection, or free of third-party rights. You are responsible for how you use Outputs.
• We do not use your Inputs or Outputs to train AI models.

Intellectual Property

The service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Termination

We may suspend or terminate your access to the service at any time if you violate these terms. You may request account closure through the support channel in your account or by contacting us.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the service.

Changes to These Terms

We may modify these Terms at any time. We will notify users of any material changes by updating the date at the top of this page and, where appropriate, sending a notice through the service.
